PRIVACY AND CANCELLATION POLICY - HOTEL JOSHED

INTRODUCTION

HOTEL JOSHED recognizes the importance of privacy and protection of personal data of its customers, suppliers and other members of the community. Therefore, it is committed to protecting the privacy and personal data of its users, in compliance with the Organic Law for the Protection of Personal Data of Ecuador and other applicable regulations. In accordance with the provisions of Article 12 of the Organic Law on Personal Data Protection, HOTEL JOSHED complies with informing its various stakeholders about the conditions under which the treatment of their personal data is given.

PERSONAL DATA THAT MAY BE PROCESSED AND THEIR PURPOSES

HOTEL JOSHED processes the personal data provided below. by its customers in their business relationships.

The personal data that may be processed from Clients are the following: 1) Identity data: names, identity card numbers, RUC, telephone/cell phone number, home address, e-mail; 2) Credit data: bank account numbers; 3) General information subscribed and delivered in the different forms, contracts and annexes in relation to the services to be received that are or have been subscribed; and 4) Any other personal data provided directly by the Client within the framework of its commercial relationship.

HOTEL JOSHED will process the personal data described herein for the following purposes: 1) For the formalization, development and execution of the commercial relationship; 2) For administrative, tax, contractual and payment management, to comply with internal and external audits, and historical backup of documents; 3) For communication and sending notifications related to the commercial relationship: such as sending legal withholdings, billing, payments, information and advertising; and 4) For compliance with legal obligations or court orders.

TRANSFERS AND ASSIGNMENT OF PERSONAL DATA

HOTEL JOSHED will only share with third parties (transfer/share) the personal data of its customers if there is a legal basis whenever a legal regulation requires such transfer/sharing.

TIME LIMITS FOR THE CONSERVATION OF PERSONAL DATA

HOTEL JOSHED will keep the personal data of its customers for the duration of the business relationship. Once finalized, we will keep your data for the periods established in the current regulations which, in general, will be for a maximum period of 7 years from the end of the business relationship. During this period the data will be kept for the purpose of meeting the requests of the Control Authorities, competent public sector entities, Courts and Tribunals, as well as to respond to any queries or complaints. Without prejudice to the aforementioned periods, the owner may request the deletion of his/her data at any time.

PERSONAL DATA PROTECTION MEASURES

HOTEL JOSHED will take technical, organizational and legal security measures to protect the personal data of its users against unauthorized access, loss, alteration or destruction.

RIGHTS OF THE HOLDERS OF PERSONAL DATA

The holders of personal data may exercise the following rights in connection with

the processing of your personal data:

  • The right of access to your data contained in the databases of HOTEL JOSHED.
  • The right to rectify and update personal data that may be incorrect or incomplete.
  • The right to have your personal data deleted, in the cases provided for in the regulations in force.
  • The right of opposition, which allows you to request the cessation of all or some of the processing, such as the sending of communications for purely commercial purposes.
  • The right to the suspension of data processing, for a limited period of time and in the cases established by the regulations in force.
  • The right to portability, which will allow you to request that we send you your personal data in a compatible, updated, structured, common, interoperable and machine-readable format, preserving its characteristics.
  • The right to revoke the consent given for the processing of your data.

To exercise their rights, holders of personal data must submit a written request to HOTEL JOSHED, specifying the right they wish to exercise and the information necessary to identify the holder of the personal data.

BASES OF LEGITIMACY

HOTEL JOSHED will process the personal data of its customers only when it has a basis of legitimacy for the purpose. HOTEL JOSHED undertakes to request your consent prior to the processing of your personal data; notwithstanding that in the absence of such consent is entitled to treat personal data under other grounds of legitimacy expressly provided by law (such as the existence of a contractual relationship, a legal or judicial order, the need to protect a vital interest, etc.).

CHANGES TO THE PRIVACY POLICY

CANCELLATION POLICY

  • All cancellations must be made in writing to the hotel's official mail or WhatsApp.
  • Cancellations made 7 days or more prior to arrival date will be refunded in full.
  • Cancellations made between 3 and 6 days in advance will be charged 50% of the amount paid.
  • Cancellations made less than 48 hours in advance or in case of no-show will not be reimbursed.
  • The client may choose to change the date of the reservation only once, subject to availability, without penalty if requested at least 5 days in advance.
  • Special rates and high season will not be reimbursed.
